Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Nikea app and website (“Nikea”, the “Service”), operated by A1Force Pty Ltd (ABN 37 623 229 327) (“A1Force”, “we”, “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old and able to form a binding contract to use Nikea. You are responsible for your account, your username (which is permanent once chosen), and for keeping your credentials secure.
2. Health disclaimer
Nikea provides general fitness and wellbeing features and is not medical advice. It is not a medical device and does not diagnose, treat or prevent any condition. Consult a qualified health professional before starting or changing any exercise, diet or measurement programme, and stop and seek advice if you feel unwell. You participate at your own risk.
3. Acceptable use
You agree not to misuse the Service, including by:
- submitting false, manipulated or automated activity data;
- harassing other members or infringing others’ rights;
- attempting to access accounts, data or systems without authorisation; or
- using the Service unlawfully or in breach of these Terms.
4. Coins, payments and prizes
- Coins are a virtual, in-app currency. One coin is priced at A$1. Coins are purchased in Australian dollars via Stripe.
- Coins have no cash value and cannot be exchanged, redeemed or withdrawn for money. They may be used only within Nikea — to enter paid challenges, receive prizes, or redeem for available rewards.
- Coin purchases are generally non-refundable, except where a refund is required by the Australian Consumer Law or other applicable law.
- Challenges & prize pools: a challenge owner may set a coin entry fee. Members who join pay from their coin balance. If you opt out of a paid challenge before it ends, your entry coins are forfeited into the prize pool. At the end, the top finishers share the pooled coins by the owner-set split. Prizes are paid in coins.
- Rewards redeemed with coins (e.g. vouchers, merchandise or charitable donations) are subject to availability and fulfilment terms shown at redemption.
5. Connected services
Features that sync data from third parties (e.g. Garmin, Fitbit/Google, Apple Health, Health Connect) and services such as Stripe are subject to those providers’ own terms and privacy policies. We are not responsible for third-party services.
6. Intellectual property
The Service, including its software, design and branding, is owned by A1Force or its licensors. You may not copy, modify or distribute it except as permitted. You retain ownership of content you upload (such as progress photos) and grant us a limited licence to store and process it to operate the Service.
7. Consumer guarantees & liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees. To the maximum extent permitted by law, the Service is otherwise provided “as is”, and A1Force is not liable for indirect or consequential loss. Where our liability can be limited, it is limited to resupplying the service or paying the cost of resupply.
8. Suspension & termination
You may stop using Nikea at any time and close your account. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will do so.
9. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
10. Changes
We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.
